Labor law: more flexible framework conditions in permanent theaters

The statutory half-day off may be granted to stage performers in the afternoon in the time slot between 12 p.m. and 10 p.m. instead of, as hitherto, between 12 p.m. and 8 p.m.

This amendment to Ordinance 2 concerning the Labor Law, decided by the Federal Council on August 30, 2023, will go into effect on October 15, 2023.

 

The half-day free week referred to in Article 21 of the Labor Law (LL) is intended to give employees who work more than five days a week time to attend to personal matters.

This half-day is considered granted if the conditions stipulated in Article 20 of Ordinance 1 concerning the Labor Law (OLL 1, RS 822.111): must last eight hours, to be accorded on a working day immediately before or after the daily rest period, and include either the entire morning, from 06:00 to 14:00, or the entire afternoon, from 12:00 to 20:00.

The work rhythm of stage artists in permanent theaters cannot be reconciled with the hitherto statutory half-day free weekly afternoon time slot.

Therefore, the new Article 14 paragraph 2bis OLL 2 takes into account the special working and resting hours of these people by allowing the half-day free week in the afternoon to be between 12 noon and 10 pm.

This special provision applies only to workers employed in permanent theaters for the artistic creation of performances.
